INVITATION FOR PREQUALIFICATION / EXPRESSION OF INTEREST (EOI) FOR WORKS, GOODS AND SERVICES

1. INTRODUCTION
The Federal Ministry of Works and Housing intends to execute some projects as contained in the 2024 Appropriation Act. In compliance with the provisions of the Public Procurement Act, 2007, Finance Act 2020 and other Extant Guidelines for the award of contracts in the Federal Public Service, the Ministry wishes to invite experienced and competent Contractors, Suppliers and Service Providers to submit Pre-qualification and Expression of Interest (EoI) documents for the execution of the Ministry’s selected projects contained on the 2024 Appropriation Act.

2. SCOPE OF WORKS/ASSIGNMENTS
Details of the Scope of Works/Specifications and Assignments are contained in the Bid Documents. The projects are grouped into categories A to C. Bidders are therefore, requested to submit Pre-qualification, Technical and Expression of Interest documents in respect of the categories chosen on the basis of the requirements listed in Sections 3.0, 4-0 and 8.0 of this publication. The projects are listed as contained in categories in the table below:

3. ELIGIBILITY REQUIREMENTS
Interested bidders should submit the following documents:
a. Evidence of Certificate of incorporation issued by Corporate Affairs Commission (CAC) including forms CAC 1.1 or CAC2 and CAC7 or Business Name is also acceptable for services;
b. Evidence of firm Tax Clearance Certificate (or personal Income tax clearance certificates of all the partners in case of Business Name) for the last three (3) years valid till 31st December 2024;
c. Evidence of Pension Clearance Certificate valid till 31st December, 2024 (this requirement is only applicable to bidders whose number of staff is 15 and above).
d. Evidence of Industrial Training Fund (ITF) Compliance Certificate valid till 31st December, 2024 (this requirement is only applicable to bidders whose number of staff is 5 and above or the bidder’s annual turnover is N50m and above);
e. Evidence of current Nigeria Social Insurance Trust Fund (NSITF) Compliance Certificate valid till 31st December, 2024;
f. Evidence of Registration on the National Database of Federal Contractors, Consultants and Service Providers by submission of Interim Registration Report (IRR) expiring on 31/12/2024 or valid Certificate issued by BPP;
g. Sworn affidavit
• disclosing whether or not any officer of the relevant committees of the Federal ministry of Works and Housing or Bureau of Public Procurement (BPP) is a former or present Director, shareholder or has any pecuniary interest in the bidder and to confirm that all information presented in its bid are true and correct in all particulars;
• that no parent/Director has been convicted in any country for criminal offences related to fraudulent or corrupt practices or criminal misrepresentation or falsification of facts relating to any matter;
• that the company does not at the time this bidding period has any existing loan or financial liability with a bank, other financial institutions or third party that is classified as doubtful, non-performing, bad or whose repayment portion has been outstanding for the last three months
• that the company is capable for working in the location area of the project for which they have are bidding
h. Company’s Audited Accounts for the last three years (2021 ,2022 & 2023);
i. Reference letter from a reputable commercial bank indicating willingness to provide credit facility for the execution of the project when needed; Bidders for category “A” projects should note that minimum annual turnover is a requirement and shall be considered based on the value of the project(s) tendered for.
j. Verifiable documentary evidence of at least three (3) similar jobs executed in the last five (5) years including letters of awards, valuation certificates, job completion certificates and photographs of the projects;
k. Evidence of registration with relevant professional body e.g NAICOM/Insurance, EHORECON/Cleaning service, NITDA/CPN/Information, COREN/QSRBN/ARCON/CORBON/SURCON/ Construction, NSCDC/Security, ESVARBON/Estate Surveying etc
l. Company’s profile with the curriculum Vitae of key staff to be deployed for the project, including copies of their academic/professional qualifications such as COREN, QSDRBN, ARCON, CORBON , SURCON, TOPREC, NIESV, CIPSMN etc;
m. For supply of Equipment: Letter of Authorization as representative of the Original Equipment Manufacturer (OEMs)
n. For supply of Medical and Laboratory Equipment: Letter of Authorization from the Original Equipment Manufacturers listed in the Approved Policy for procurement of Health and Medical Equipment for Tertiary Hospitals in Nigeria ;
o. Only companies included in the National Automotive design and development Councils approved list of Local manufacturers of vehicles or their authorized representatives should bid for the vehicle.
p. Consultancy services: evidence of current registration with relevant regulatory professional body(ies) such as CMD, NITDA etc
q. Local content, safety and social responsibility
(For category A, B, C the following shall further considered at the financial bid submission stage for projects value greater/equal to N300 million)
a. Indicate the quantum of verifiable employment to be generated stating projected number and specialties for skilled (Professional) and unskilled (Non- Professional) manpower.
b. Submit verifiable key management positions that are Nigerian Nationals and the percentage of the company’s total workforce that will be beneficial to youth employment and community development in Nigeria;
c. All bidders should include description of current Health, Safety and Environment (HSE) procedures, plans, manuals and HSE performance statistics over the last 3 years including HSE manuals and accident statistics for the past five (5) years and
d. Submit a plan on how to give first consideration to services provided from within Nigeria, raw materials and manufactured goods of Nigerian origin in line with the requirements of Executive Order No. 5 on promotion of Nigerian Content.
e. State the proposed social benefits to be accrued to the host communities where projects/services are domiciled.
r. For Joint Venture/Partnership, Memorandum of Understanding (MoU)) should be provided (CAC, Tax Clearance Certificate, Pension Clearance Certificate, ITF Compliance Certificate, NSITF Clearance Certificate, IRR & Sworn Affidavit are compulsory for each JV partner)
Note: All documents for submission must be transmitted with a Covering/Forwarding letter under the Company/Firm’s Letter Headed Paper bearing amongst others, the Registration Number (RC) as issued by the Corporate Affairs Commission (CAC), Contact Address, Telephone Number (preferably GSM No.), and e-mail address. The Letterhead Paper must bear the Names and Nationalities of the Directors of the Company at the bottom of the page, duly signed by the authorized officer of the firm

4. SUBMISSION OF EOI
Interested firms are to submit two (2) bound of Expression of Interest (Eol) documents separated by dividers and arranged as indicated above. The documents should be submitted in a sealed envelope and addressed to The Permanent Secretary, Federal Ministry of Works and clearly marked with the name of the project and the Lot number. Furthermore, the reverse of each sealed envelope should bear the name and address of the bidder and drop in the designated Tender Box at the Public Procurement Department, Room A124, Block A, 1st Floor FMW, Mabushi, Abuja not later than 12:00 noon on Thursday, 20 June, 2024.

5. SUBMISSION OF PRE-QUALIFICATION DOCUMENTS
Prospective Bidders are to submit Pre-Qualification documents for each desired Lot in two (2) hard copies each of the Technical Bids packaged in a sealed envelope and clearly marked as “Technical Bid”, and addressed as indicated above, and submitted not later than before 12:00 noon on Thursday, 20 June, 2024.

6. OPENING OF BIDS/EOI DOCUMENTS
The EOIs/Technical bids will be opened immediately after the deadline for the submission at 12:00 noon Thursday, 20 June, 2024, at the Conference Hall, 1st Floor, Block A, FMW, Mabushi, Abuja. Please, ensure that you sign the Bid Submission Register at the address above as the Ministry will not be held liable for misplaced or wrongly submitted bids. 7. GENERAL INFORMATION
a. EOIs/Bids must be in English Language and signed by an official authorized by the bidder,
b. EOIs/Bids submitted after the deadline for submission would be returned un-opened;
c. Bidders should not bid for more than Two (2) Lots:
d. All costs will be borne by the bidders;
e. The EOIs/Technical Bids will be opened in the presence of Bidders or their representatives, CSOs in the areas of Anti-Corruption and Transparency and Private Professional bodies, and will be covered by video recording; invitation link will be sent to bidder who chooses to join the bid opening online
f. Bidders are advised to bid for projects in locations of capability/capacity,
g. This advertisement shall not be construed as a commitment on the part of the Ministry to award contract to any bidder
h. Bid documents can also be collected in soft copies and Bidders shall submit through Post (Courier services);
i. Only pre-qualified bidders at technical evaluation will be invited at later date for collection of tender documents;
j. Consultancy services: Only shortlisted firms will be invited at a later date for collection of Request for Proposals
k. The Federal Ministry of Works is not bound to prequalify and bidder reserves the right to annul the procurement process at any time without incurring any liabilities in accordance with section 28 of the Public Procurement ACT 2007.
