1.0 INTRODUCTION

The intent of this Request for Proposals (RFP) or Solicitation is to secure competitive proposals for the provision of data protection compliance services that will support and foster Africa Re’s compliance with existing key legislations requirements across the Corporation’s operational environment as well as with the Global Data Protection Regulation (GDPR).

This will include Data Protection Compliance Assessment, Personal data Inventory, Data Protection Impact Assessment (DPIA), Training and Capacity Building, Implementation of Data Protection Compliance (Drafting the Corporate Data Protection Policy in line with applicable key regulatory requirements, drafting the Data Protection Governance Model and documenting roles and responsibilities for data protection functions, etc.).

2.0 PROJECT BACKGROUND
Africa Re’s operational environment is characterized by evolving and diverse legislation and regulation requirements. The main objectives pursued through these regulations are:

• Giving citizens more control over their personal data with a view to catering for growing privacy protection aspirations.

• Introduce new rights for citizens (right to portability of personal data, right to be forgotten) in today’s data-driven world.

• Increase awareness of data regulation through a system of penalties (fines).

Furthermore, the EU General Data Protection Regulation (GDPR) is a legal framework that sets guidelines for the collection and processing of personal information of EU residents and came into effect from May 25, 2018. The GDPR applies to any organization, regardless of their geographic location; who are either “Controller” (i.e. public authority, agency or other body who determines the purposes and means of the processing of personal data) or “Processor” (i.e. public authority, agency or other body which processes personal data on behalf of the controller), of the data of EU residents.

REQUEST FOR EXPRESSIONS OF INTEREST (REOI)

The Federal Government of Nigeria (FGN) has obtained a credit from the International Development Association- IDA (the “Bank”). This credit will be used to implement activities that will catalyze the process of economic diversification through the mining sector.

The Mineral Sector Support for Economic Diversification Project, the implementing agency intends to apply part of the proceeds for eligible payments under the contract for the engagement of a consultant to support the MMSD in developing and implementing a strategy to revive the tin industry in Nigeria and develop the barite industry in Nigeria.

The primary objective of this advisory work is to advise and assist the Ministry of Mines and Steel Development (MMSD) to:
(a) Prepare and implement a detailed strategy to revive the tin industry in Nigeria to have a competitive and sustainable supply chain and market for tin through a strong focus on the following:
(i) Upstream and downstream integration.
(ii) Clusters of geology-mining-mineral processing-smelter and downstream manufacturing industries.
(b) Develop the Barite industry in Nigeria through a strong focus on the following:
(i) Upstream and downstream development of the selected indigenous Nigerian barite mining and milling companies.
(ii) Examine the selected indigenous barite mining and milling companies that can be nurtured.
(iii) Assist in implementing a program that should consider a range of support mechanisms to the selected companies, including on-site business advice, professional services assistance, and connections with strategic partners, and mentoring to produce successful and financially viable firms that can survive on their own and adequately supply quality barite to the Oil and Gas Industry;
(iv) Assist the selected indigenous Barite mining and milling company to develop a sound environmental and social management system including a community development plan.

The Consultant’s duties will involve working closely with the consultant undertaking the ASM development task and any other relevant consultancies where necessary. The adviser is expected to consult widely with key stakeholders and assist in the organization of a Stakeholder’s workshop to include the operators and stakeholders in the tin and barite industry value chain. This should also include all concerned Government regulatory agencies and representatives from academia, mining associations, finance and banking, civil society organizations and standards entities, etc.

The adviser is expected to carry out the following tasks in collaboration with the MMSD and the relevant departments and agencies:

Tin Industry:
• Situation Analysis
• Strategy Preparation
• Strategy Implementation

Barite Industry:
• Due Diligence Audit and Situation Analysis
• Business Plan Development
• Strategy Implementation

The Mineral Sector Support for Economic Diversification (MinDiver) Project now invites eligible consulting firms (“Consultant”) to indicate their interest in providing the above services. An interested firm must provide information demonstrating that they have the required qualifications and relevant experience to perform the services. (i.e. Letter of interest, Brochure, Description of similar assignments, availability of essential technology and other logistic resources, availability of appropriate skills amongst Staff, etc.)

The shortlisting criteria are:
(i) General listing of project experiences for the last ten years, including the completed and the on-going projects and their value.
(ii) Specific description of the similar assignments in the last ten years (Please include verifiable evidence of work done e.g. Job Completion Certificate, Letter of Award of contract, etc.)
(iii) Specific experience in countries with similar conditions as Nigeria
(iv) The firm Organisation structure, i.e. human resources, adequacy of the staff to perform the components of the technical task. (Permanent and Management Staff are evaluated here)
For each project performed the consultant shall provide the name and contact address of the client (office & e-mail address, and telephone number), date(s) of execution, name(s) of lead and associate firms, contract amount.
